OT Rooftop Lease
Purpose. The purpose of this page is to determine the next steps to a push-back strategy to American Tower (or Sprint) on the cost to them to use our rooftop. (Currently we get $1,000 per year, through 2098.)
Background. Both the size of the conduit allowed and running conduit up our stairwells are the focus. In 2017 we engaged Russell Davis to take a look the agreements. Basically, he said the contracts are ambiguous around the conduit size and could possibly be challenged. Because we granted them permission to use the stairwell that could be a strong pushback from them. He said we could hire legal representation of try to approach ATC directly.
- Stairwell Conduit. We are in agreement that they are out of scope using the stairwell; However, we allowed them to do it thus we have a gray area here. Since we gave them notice they no longer "add" cables to the stairwell. Originaly approved cables still exist in the east stairwell.
- Conduit Size. Ref page 2, paragraph (d) (i) of the 1998 agreement, allows them to add one additional 8" conduit.
- Notified ATC or ??.
- In xxxx we sent notice to yyy to tell them they were out side the scope in the stairwells and possibly in the overall conduit ...
