Declaration, Bylaws, & Rules
Declaration, Bylaws, & Rules
Declaration. The OT Declaration was established on October 30, 1998. Changing the Declaration requires a vote of 67% of the Percentage of Value (Owner sq ft) assigned to all units. [Paragraph 20.A (3), page 40] Changes to the Declaration are documented by Amendments. OT has 24 Amendments. The OT Declaration can not conflict with the intent of State laws.
Bylaws. The OT Bylaws were also established on October 30, 1998. Changing the Bylaws requires a vote of 51% of the Percentage of Value assigned to all units. [Article 11, page 14] The OT Bylaws can not conflict with the intent of State laws or the OT Declaration.
Rules. The OT HOA Board, with a majority Board vote can establish and/or rescind any Rule. The OT Rules can not conflict with the intent of State laws, the OT Declaration or the OT Bylaws. [Bylaws Article 6, page 10]
Bylaws. The OT Bylaws were also established on October 30, 1998. Changing the Bylaws requires a vote of 51% of the Percentage of Value assigned to all units. [Article 11, page 14] The OT Bylaws can not conflict with the intent of State laws or the OT Declaration.
Rules. The OT HOA Board, with a majority Board vote can establish and/or rescind any Rule. The OT Rules can not conflict with the intent of State laws, the OT Declaration or the OT Bylaws. [Bylaws Article 6, page 10]

At the July 14, 2022 board meeting the board amended rule 7.5 as follows:
7.5. Holiday Lights/Decorations. Residents may string lights on balcony rails for the holiday season. Holiday lighting can be installed and turned on any time beginning the day before Thanksgiving and must be removed or turned off no later than the Sunday of first full weekend in January. For Fiesta, residents can decorate balconies as long as decorations are appropriate and do not interfere with other balconies. Residents are allowed to display the official red, white and blue US Flag.

Some Governing Items. As an FYI, the following are a few regularly referred to Governing items.
Owner Voting. When voting for elections or changing our Declaration/Bylaws, votes are weighted according to the square footage owned. (Declaration, Paragraph 7.C., page 14)
Mortgage Company Updates. Each Owner is required to inform the Building Manager if they have a mortgage, and if so provide current mortgage company contact information. (Declaration, Paragraph 18.A., page 39.)
Change in Ownership. Each Owner is required to inform the building Manager as soon as possible of any pending or change in Ownership.
Parking.
- The Owner of each Unit will be allocated one (1) reserved parking space. (Declaration, Paragraph 3.E., page 8)
- Additional spaces can be assigned if available.
Mortgage Company Updates. Each Owner is required to inform the Building Manager if they have a mortgage, and if so provide current mortgage company contact information. (Declaration, Paragraph 18.A., page 39.)
Change in Ownership. Each Owner is required to inform the building Manager as soon as possible of any pending or change in Ownership.
